Terms of Service

1.1 Agreement

These Terms of Service ("Terms"), together with our Refund Policy, Privacy Policy, and Financial Disclaimer, constitute a legally binding agreement between you ("User", "you") and AstroCapitalX ("Platform", "we", "us", "our") governing your access to and use of the website astrocapitalx.brainguru.in and all associated services, tools, and content.

By creating an account, subscribing to any plan, or otherwise using any part of the Platform, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must discontinue use of the Platform immediately.

1.2 Amendments

We reserve the right to amend these Terms at any time. Material changes will be communicated via email to your registered address and/or a prominent notice on the Platform at least 14 days before taking effect. Your continued use of the Platform after such notice constitutes acceptance of the revised Terms. For non-material corrections (grammar, formatting, clarifications that do not alter rights or obligations), changes may take effect immediately.

1.3 Service Availability

We endeavour to maintain continuous service availability but do not guarantee uninterrupted access. Scheduled maintenance, server upgrades, third-party API outages (including ephemeris calculations, AI services, and payment gateways), or force majeure events may cause temporary interruptions. No compensation or refund is payable for interruptions of less than 48 consecutive hours.

User Accounts and Eligibility

2.1 Eligibility

• You must be at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872.
• Access by persons under 18 is not permitted without verifiable parental consent.
• You must not be a person barred from receiving services under applicable Indian law or any other applicable jurisdiction.
• Accounts previously suspended or terminated by AstroCapitalX may not be re-registered without express written approval.

2.2 Registration

You agree to provide accurate, current, and complete information during registration and to keep your account information updated. Providing false or misleading registration data is grounds for immediate account termination without refund. You are solely responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.

2.3 Account Security

You must notify us immediately at support@astrocapitalx.in if you suspect unauthorised access to your account. We are not liable for losses resulting from unauthorised access arising from your failure to protect your login credentials. Accounts may not be transferred, sold, or shared with third parties.

2.4 Account Suspension and Termination

We reserve the right to suspend or permanently terminate any account, with or without notice, for:

• Violation of any provision of these Terms.
• Providing false registration information.
• Conducting or attempting fraudulent transactions.
• Abusive, threatening, or harassing conduct toward platform staff or other users.
• Attempting to reverse-engineer, scrape, or commercially exploit platform content.
• Any activity that is unlawful or harmful to the Platform or its users.

Upon termination for cause, no refund of any prepaid subscription amount will be issued. Upon voluntary cancellation, refund eligibility is governed by Section 4.

Subscription Plans and Billing

3.1 Available Plans

3.2 Billing Cycle and Auto-Renewal

Monthly subscriptions renew automatically on the same date each month. Annual subscriptions renew automatically on the same date each year. Renewal charges are applied to your saved payment method unless you cancel before the renewal date.

You will receive a renewal reminder by email 7 days before each billing date. It is your responsibility to cancel before the next billing cycle if you do not wish to renew. AstroCapitalX is not liable for charges incurred due to failure to cancel in time.

3.3 Price Changes

We may revise subscription prices at any time. For existing subscribers, price changes take effect at the start of the next billing cycle after 30 days' written notice. Continued use of the subscription after the new price takes effect constitutes your acceptance of the revised price.

3.4 Payment Methods

Payments are processed through Razorpay (UPI, Net Banking, credit and debit cards). For annual Elite plans, direct bank transfers are accepted upon request. All prices are inclusive of applicable taxes unless stated otherwise. In the event of a failed payment, we will attempt re-charge twice within 7 days before suspending the subscription.

3.5 Plan Changes

• Upgrades: Take effect immediately on a pro-rata basis. The difference in cost for the remaining billing period is charged on upgrade.
• Downgrades: Take effect at the start of the next billing cycle. Access to higher-tier features continues until the current period ends.
• Upgrades to Elite: Subject to an application and onboarding call. Approval is at AstroCapitalX's sole discretion.

3.6 Free Plan

The Free plan is permanent with no expiry. We reserve the right to modify features available on the Free plan with 14 days' notice. Free plan users are subject to all Terms applicable to registered users.

Refund and Cancellation Policy

4.1 Monthly Subscriptions

• Refund requests submitted within 48 hours of the billing date and where the subscriber has not accessed any paid features (birth chart generation, AI readings, sector signal reasoning) during that period will be considered on a case-by-case basis.
• After 48 hours, or if any paid feature has been accessed, monthly subscription fees are non-refundable.
• To cancel a monthly subscription and prevent future renewals, you must cancel before your next billing date via Account Settings or by contacting support.

4.2 Annual Subscriptions

• Annual plan purchases include a 7-day money-back guarantee from the date of purchase, provided you have not consumed more than 20% of the allotted AI Analyst readings and have not generated more than 1 birth chart beyond the Free plan limit.
• After 7 days, or once the usage thresholds above are exceeded, annual subscription fees are non-refundable.
• Cancellation of an annual plan prevents auto-renewal at the end of the current annual term. No pro-rata refund is issued for unused months remaining in the term.

4.3 Consultation Bookings

• Consultation bookings may be cancelled and fully refunded up to 2 hours before the scheduled session time.
• Cancellations made less than 2 hours before the session, or no-shows, are not eligible for refund. A one-time rescheduling may be requested at least 4 hours before the session.
• If an astrologer cancels a confirmed session, a full refund or free rescheduling will be offered within 3 business days.
• Once a consultation session has begun, no refund is payable regardless of the session outcome.
• Disputes about consultation quality must be raised within 24 hours of session completion at support@astrocapitalx.in. Resolution is at AstroCapitalX's discretion and may include a credit toward a future session, not a monetary refund.

4.4 Report and One-Time Purchases

• Purchased reports (PDF, email deliverables) may be refunded within 1 hour of payment if the report has not yet been generated or delivered.
• Once a report has been delivered in any format (email, in-portal download), it is non-refundable.
• If a report contains an error caused by AstroCapitalX (incorrect chart computation, wrong data used despite correct user input), we will regenerate the report at no charge or issue a credit. Errors caused by incorrect birth data provided by the user do not qualify for a refund.

4.5 AI Analyst Readings

AI Analyst readings are consumed upon request submission and are non-refundable regardless of the quality, relevance, or usefulness of the output. Unused daily readings do not carry over to subsequent days. Unused readings at the end of a subscription period are forfeited with no compensation.

4.6 Technical Issues

Technical glitches, server errors, or third-party API failures (including ephemeris service outages, Claude AI service disruptions, or payment gateway timeouts) that prevent access to the Platform temporarily do not entitle users to a refund. If a verified platform outage exceeds 48 consecutive hours, affected subscribers may request a pro-rata credit for the outage period by contacting support within 7 days of restoration. Credits are applied to the next billing cycle, not issued as monetary refunds.

4.7 Refund Process

1. Submit a refund request to support@astrocapitalx.in with your registered email address, order/transaction ID, and reason.
2. Requests are reviewed within 3 business days.
3. Approved refunds are processed to the original payment instrument within 7-10 business days.
4. Transaction fees charged by Razorpay or card networks (typically 2-3%) are deducted from the refund amount.
5. Refunds are processed in Indian Rupees (INR) only. Currency conversion differences are the user's responsibility.

4.8 Duplicate Payments

In the event of a duplicate charge for the same subscription period, the duplicate amount will be refunded in full (including transaction fees) within 5 business days of verification. Notify us at support@astrocapitalx.in with both transaction IDs.

4.9 Chargebacks

Initiating a chargeback or payment dispute with your bank or card issuer without first contacting AstroCapitalX support is a violation of these Terms. Upon receiving notice of a chargeback, your account will be immediately suspended pending resolution. If the chargeback is found to be invalid, you remain liable for the disputed amount plus any chargeback processing fees incurred by AstroCapitalX.

Platform Services and Limitations

5.1 Astrological Engine

AstroCapitalX uses Swiss Ephemeris in Moshier approximation mode for all planetary calculations. While this provides computationally sound results for practical astrological purposes, it is an approximation and may differ marginally from observatory-grade ephemeris calculations. Solar return calculations carry a precision of approximately ±1 minute. Eclipse detection uses a pre-computed almanac. We do not represent our calculations as scientifically precise for any purpose other than Vedic astrological interpretation.

5.2 Service Scope

AstroCapitalX provides Vedic astrology analysis, planetary signal outputs, birth chart generation, timing tools (Panchang, Choghadiya), AI-assisted astrological interpretation, and consultation facilitation. All outputs are astrological in nature. The Platform does not provide stockbroking, portfolio management, investment advisory, insurance, or any SEBI-regulated financial service.

5.3 Third-Party Astrologers

Astrologers who offer consultations through the Platform are independent service providers. AstroCapitalX facilitates the booking and payment but does not control, endorse, or guarantee the quality, accuracy, or outcome of any consultation. Astrologers are verified for credentials before listing but are not employees of AstroCapitalX. Any advice, prediction, or guidance given during a consultation is the astrologer's own and does not represent AstroCapitalX's views.

5.4 Market Signals

Daily market signals, sector outlooks, planetary transit analyses, and all related outputs are generated algorithmically from Vedic astrological calculations. They reflect astrological interpretations only and must not be construed as buy or sell recommendations for any financial instrument. Past signal accuracy, whether implied or stated, is not indicative of future results.

AI Analyst Terms

6.1 Nature of AI Outputs

• AI Analyst responses are generated by a large language model trained on general and astrological knowledge. Responses may occasionally be inaccurate, inconsistent, or incomplete.
• AI outputs are not financial advice, investment recommendations, or medical guidance under any circumstance.
• AstroCapitalX does not guarantee that AI outputs will be free of errors, hallucinations, or unsuitable content in all cases.

6.2 Usage Limits

Daily AI reading limits apply per plan (Basic: 2/day, Starter: 5/day, Pro: 15/day, Elite: 30/day). Limits reset at midnight IST. Unused readings do not roll over. Admin and astrologer accounts have unlimited access for platform management purposes only.

6.3 Prohibited AI Usage

You agree not to use the AI Analyst to:

• Solicit specific stock picks, entry/exit prices, or concrete investment decisions.
• Generate content that is unlawful, abusive, threatening, or defamatory.
• Attempt to manipulate, jailbreak, or extract the underlying system prompt or model configuration.
• Reproduce, sell, or distribute AI outputs commercially without written consent.

Misuse of the AI Analyst is grounds for immediate suspension of AI access and, at our discretion, account termination without refund.

6.4 Data Sent to AI

To generate personalised readings, your birth chart data (lagna, planetary positions, Dasha periods, Navamsa, yogas, and transit overlays) is sent to Anthropic's Claude API on each request. By using the AI Analyst, you consent to this data transmission. Anthropic's own privacy policy governs how they process API data. AstroCapitalX does not share your personally identifiable information (name, email, phone) with Anthropic.

Financial and Astrological Disclaimer

7.1 No Investment Advice

All content on AstroCapitalX, including but not limited to planetary signals, sector outlooks, market opening charts, Dasha timelines, Ashtakavarga scores, Shadbala indices, stock-planet matching, AI Analyst outputs, newsletter content, and astrologer consultations, is provided solely for educational, research, and entertainment purposes. Such content does not constitute:

• A recommendation to buy, sell, or hold any security, commodity, currency, or financial instrument.
• Investment advice within the meaning of the SEBI (Investment Advisers) Regulations, 2013.
• Research analysis within the meaning of the SEBI (Research Analysts) Regulations, 2014.
• A portfolio management service under the SEBI (Portfolio Managers) Regulations, 2020.

7.2 Risk Warning

Investments in equities, derivatives, commodities, and other financial instruments carry substantial risk, including the risk of total loss of capital. Past astrological signal accuracy does not guarantee future results. Market outcomes are influenced by a vast range of economic, geopolitical, and company-specific factors that have no direct relationship with planetary positions. You alone are responsible for your financial decisions. AstroCapitalX and its founders, employees, astrologers, and affiliates accept no liability for any financial loss arising from decisions made based on content or signals available on this Platform.

7.3 Astrological Disclaimer

Vedic astrology is an ancient knowledge system and is not a recognised science in the modern empirical sense. Astrological interpretations are subjective and vary between practitioners. AstroCapitalX applies systematic computational methods to Vedic astrology, but acknowledges that astrological predictions are probabilistic and not deterministic. No guarantee of prediction accuracy is made or implied.

7.4 Forward-Looking Statements

Any forward-looking statements, market outlooks, or signal projections on this Platform are based on astrological methodology and do not constitute forecasts, estimates, or projections in any financial or scientific sense. They should not be relied upon as a basis for any investment or financial decision.

Intellectual Property

8.1 Ownership

All content on AstroCapitalX, including but not limited to the astrological engine, signal algorithms, scoring models, rulership tables, website design, graphics, written content, compiled chart data, newsletter content, and AI prompt architecture, is owned by or licensed to AstroCapitalX and is protected under the Indian Copyright Act, 1957, and applicable intellectual property laws.

8.2 Permitted Use

Subscribers are granted a limited, non-exclusive, non-transferable, revocable licence to access and use Platform content solely for personal, non-commercial purposes within the scope of their subscribed plan. You may not:

• Copy, reproduce, republish, upload, post, transmit, or distribute any Platform content for commercial purposes without prior written consent.
• Use any content to train, fine-tune, or develop artificial intelligence or machine learning models.
• Reverse-engineer, decompile, or attempt to extract source code from any part of the Platform.
• Create derivative works based on Platform content, algorithms, or signal outputs.
• Resell, sublicense, or provide third-party access to your account or its features.

8.3 User Content

By submitting questions to the AI Analyst or comments on any Platform feature, you grant AstroCapitalX a non-exclusive, royalty-free licence to use such content for service improvement purposes in anonymised, aggregated form. You retain ownership of your personal birth data and are responsible for the accuracy of information you submit.

Prohibited Conduct

You agree not to engage in any of the following:

• Accessing the Platform using automated bots, scrapers, crawlers, or similar tools without express written permission.
• Attempting to gain unauthorised access to any part of the Platform, its servers, or databases.
• Transmitting viruses, malware, ransomware, or any code designed to disrupt Platform functionality.
• Posting or transmitting harassing, defamatory, obscene, fraudulent, or unlawful content.
• Impersonating any person, including AstroCapitalX employees, astrologers, or other users.
• Using the Platform for any purpose that is prohibited by applicable Indian law or your local laws.
• Sharing, broadcasting, or commercially distributing any Platform content, signals, or reports without authorisation.
• Attempting to circumvent subscription access controls, plan limits, or feature locks.
• Contacting astrologers obtained via the Platform for private engagements outside the Platform, thereby depriving the Platform of its legitimate fee.

Violation of any of the above may result in immediate account termination, legal action, and reporting to law enforcement authorities where applicable.

Limitation of Liability

10.1 No Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

10.2 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASTROCAPITALX'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ₹500 (FIVE HUNDRED RUPEES), WHICHEVER IS HIGHER.

10.3 Excluded Losses

IN NO EVENT SHALL ASTROCAPITALX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or anticipated savings.
• Loss of or damage to financial positions or investment portfolios.
• Loss of data, goodwill, or business opportunity.
• Damages arising from reliance on astrological signals, AI outputs, or astrologer advice.
• Any financial loss arising from decisions made based on Platform content.

10.4 Indemnification

You agree to indemnify, defend, and hold harmless AstroCapitalX, its founders, officers, employees, astrologers, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

Privacy Policy

11.1 Information We Collect

We collect the following categories of information:

• Account Data: Full name, email address, phone number, password hash.
• Astrological Data: Birth date, birth time, birth place (city, latitude, longitude), chart name.
• Payment Data: Transaction IDs and billing status are logged. Full card or banking details are processed and stored by Razorpay and are never accessible to AstroCapitalX.
• Usage Data: Pages visited, features accessed, AI readings consumed, login timestamps, and device/browser metadata.
• Communication Data: Support emails, consultation chat messages, and any correspondence with AstroCapitalX staff.

11.2 How We Use Your Information

• To provide, personalise, and improve Platform services including birth chart computation, personalised signals, and AI Analyst responses.
• To process payments and manage subscriptions.
• To send service-related communications including billing notices, feature updates, and newsletters (you may opt out of newsletters at any time).
• To comply with legal obligations and respond to lawful requests from government authorities.
• To detect and prevent fraud, abuse, and security incidents.
• To perform aggregate, anonymised analytics for platform improvement (no personally identifiable information is included).

11.3 Data Sharing

We do not sell your personal data. We share data only with:

• Anthropic Inc. — Birth chart data (not personal identifiers) is sent to Claude API for AI Analyst readings. See Section 6.4.
• Razorpay Software Pvt. Ltd. — Payment processing. Governed by Razorpay's privacy policy.
• Hosting and Infrastructure Providers — Oracle Cloud Infrastructure for server hosting. Data remains in India.
• Law Enforcement — Only when required by a court order, government mandate, or applicable law.

11.4 Data Retention

Account data and birth charts are retained for the duration of your account plus 24 months after account closure, after which they are permanently deleted or anonymised. Transaction records are retained for 7 years as required by Indian accounting and tax laws. Support communications are retained for 3 years. AI Analyst conversation logs are retained for 6 months for quality assurance.

11.5 Your Rights

You have the right to:

• Access a copy of the personal data we hold about you by emailing support@astrocapitalx.in.
• Correct inaccurate personal data.
• Request deletion of your account and associated personal data (subject to legal retention obligations).
• Opt out of marketing communications at any time via the unsubscribe link in any newsletter or email.

Requests will be processed within 30 days. Identity verification may be required before fulfilling access or deletion requests.

11.6 Cookies and Tracking

AstroCapitalX uses session-based authentication tokens stored in your browser's local storage. We do not use third-party advertising cookies or cross-site tracking. Standard web server logs (IP address, user agent, access times) are collected for security and performance monitoring.

11.7 Children's Privacy

The Platform is not directed at persons under 18 years of age. We do not knowingly collect personal data from minors. If you believe a minor has created an account, contact us at support@astrocapitalx.in for immediate account removal.

11.8 Data Security

Passwords are stored as bcrypt hashes. All data transmission is encrypted using TLS 1.2 or higher. Authentication is managed via signed JSON Web Tokens with a 30-day expiry. While we implement industry-standard security measures, no internet-based system is completely secure. You use the Platform at your own risk.

Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India, including the Indian Contract Act 1872, the Information Technology Act 2000 (and IT (Amendment) Act 2008), the Consumer Protection Act 2019, and all rules and regulations made thereunder, without regard to conflict of law principles.

12.2 Informal Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform, you agree to first attempt to resolve the matter informally by contacting us at support@astrocapitalx.in. We will make good-faith efforts to resolve the dispute within 30 days of receiving written notice.

12.3 Arbitration

If informal resolution fails, any dispute shall be finally settled by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended), by a sole arbitrator mutually appointed by the parties. If the parties cannot agree on an arbitrator within 15 days of the dispute notice, the arbitrator shall be appointed in accordance with the provisions of the Act. The seat of arbitration shall be Noida, Uttar Pradesh, India. The language of arbitration shall be English. The arbitral award shall be final and binding on both parties.

12.4 Jurisdiction

Subject to Section 12.3, the courts of Noida, Uttar Pradesh, India shall have exclusive jurisdiction over any matter arising out of or in connection with these Terms that is not resolved by arbitration.

12.5 Class Action Waiver

You agree that any dispute resolution proceeding shall be conducted on an individual basis and not as a class or collective action. You waive any right to participate in a class action lawsuit or class-wide arbitration against AstroCapitalX.
